Maryland Department of Labor: Proposing an Extension of the Implementation of the FAMLI Program

The Maryland Department of Labor is proposing an extension of the timeline for implementation of the FAMLI program 

If approved, please note the changes in program implementation dates for both payroll deductions and benefit eligibility:  

  • Payroll deductions would begin January 1, 2027 (currently scheduled for July 1, 2025) 
  • Benefits would become available on January 1, 2028 (currently planned for July 1, 2026) 

Maryland Family and Medical Leave Insurance (FAMLI) program overview:  

The Maryland Family and Medical Leave Insurance (FAMLI) program was established to provide up to 12 weeks of combined Family or Medical Leave for the following reasons:​ 

  • To care for new child (adoption, birth, foster placement, and kinship care), ​ 
  • To care for family with serious health condition​ 
  • Medical leave: Care for one’s own serious health condition ​ 
  • Qualifying military exigency or care for service member ​ 

Eligible workers who have worked 680 hours over past four calendar quarters can receive up to 12 weeks of paid leave​ 

  • The program covers various types of leave for employees: ​ 
  • Up to 12 weeks of combined Family or Medical Leave in an application year​ 
  • Up to an additional 12 weeks of leave is available for a bonding leave and an employee’s own health condition are received in the same application year ​ 
  • Intermittent Leave must be taken in increments of 4 hours per day 

The program applies to all employers with one or more Maryland-based employees ​ 

Employers with 15 or more employees will contribute 0.90% of wages, and spilt equally (0.45%) between employee and employer contributions ​ 

Employers with fewer than 15 employees will be responsible for contributing 50% of 0.90% of wages​ 

Maximum benefit is $1000 per week, and the minimum is $50 per week 

The Maryland Department of Labor will oversee the program, including the collection of contributions and the distribution of benefits​
