MO Earned Sick Leave and MD, DE Paid Leave Updates

The following are several leave law updates; including legal challenges to the Missouri Earned Sick Leave law, new implementation dates for Maryland Paid Family Leave Insurance (FAMLI) and upcoming deadlines for Delaware Paid Sick Leave funding contributions: 

Missouri Earned Paid Sick Leave  

Despite ongoing litigation and legislative challenges, the start date and notice period for the law are currently expected to remain unchanged. Employers should prepare for implementation, provide mandatory notices and display posters.  

  • Effective Date: Proposition A’s earned paid sick time provisions take effect on May 1, 2025.  
  • Accrual Rate: Employees earn 1 hour of sick leave for every 30 hours worked, with a carryover limit of 80 hours per year.  
  • Applicability: Applies to almost all Missouri employees, including full-time, part-time, and temporary workers.  

Notice and Poster Requirements:  

  • Written Notice: Employers must provide written notice to employees by April 15, 2025, using a standardized notice from the Missouri Department of Labor & Industrial Relations.  
  • Poster Display: Employers must display a poster detailing the sick time policy in a conspicuous place at each workplace starting April 15, 2025.  

Litigation Update:  

  • Supreme Court Case: Oral arguments were heard on March 12, 2025, challenging the constitutionality of Proposition A. The ruling is expected within 100-200 days.  

Legislative Update:  

  • House Bill 567: Passed in the Missouri House on March 13, 2025, seeking to repeal paid sick leave provisions, delay minimum wage increases, and eliminate annual adjustments. If passed, it will take effect on August 28, 2025.

New implementation dates for Maryland FAMLI  

Maryland General Assembly has passed a final bill setting new implementation dates for Maryland’s Paid Family and Medical Leave Insurance program:  

  • Payroll deductions will start on January 1, 2027.  
  • Benefits will be available from January 3, 2028.  

The Governor is expected to sign the bill soon. Following this, MD Labor will begin updating proposed regulations and all changes will be posted via their website.

Delaware Paid Leave (DPL)  

Starting January 1, 2026, Delaware will implement its Paid Leave program. This initiative aims to support employees during significant life events by providing paid leave. Key details include:  

  • Eligibility: Employees who have worked for at least one year and 1,250 hours with a single employer are eligible.  
  • Benefit Amount: Eligible employees can receive up to 80% of their wages, capped at $900 per week.  
  • Types of Leave:  
  • Parental Leave: Up to 12 weeks per year to bond with a new child.  
  • Family Caregiver Leave: Up to 6 weeks every 24 months to care for a family member with a serious health condition.  
  • Medical Leave: Up to 6 weeks every 24 months for the employee’s own serious health condition.  
  • Military Exigency Leave: Up to 6 weeks every 24 months to assist while a family member is on overseas military deployment.  
  • Maximum Leave: Employees can take a maximum of 12 weeks of combined leave per year.  
  • Funding: The program is funded by payroll deductions, which will be less than 1% of an employee’s weekly salary. The initial rate is 0.8% of wages up to the Social Security maximum and can be shared equally between employees and employers. The first contribution due date is April 30, 2025.   
  • Employer Participation: Most businesses with 10 or more employees are required to participate.
